Article Icon 1Supreme Court Rejects Mining Appeal

The U.S. Supreme Court on Tuesday declined to hear an appeal that could prevent copper mining at Oak Flat on ground the San Carlos Apache Tribe considers sacred.

The court left in place a lower court’s decision allowing the transfer of Tonto National Forest land to Resolution Copper. The land includes the second-largest known copper deposit in the world.

The court did not explain its decision. Justices Neil Gorsuch and Clarence Thomas dissented, citing issues involving religious freedom.

A spokesperson for Resolution Copper has said the company has made “major changes” to reduce the impact on tribes. 
The Apache Stronghold advocacy group vowed to continue the legal fight.

Article Icon 1HOA Orders Removal of Memorial Display

A homeowners’ association in Surprise ordered a woman to take down a display honoring her late brother, a U.S. Army sergeant killed in Afghanistan in 2008, saying the display had been up far longer than the HOA’s rules allow.

Resident Kendall Rasmusson said she decorated her home with a magnetic garage poster, flags, banners, and lawn decorations displaying her brother’s picture.

The HOA alleges the poster was up for several months, qualifying it as a permanent exterior feature instead of a decoration, which can be displayed for 30 days before a holiday and 10 days after.

Taiwan Semiconductor Manufacturing Co. requested exemptions from tariffs on foreign-made chipmaking materials, arguing they make U.S. chip production less competitive.

Responding to a request for input by the U.S. Department of Commerce, TSMC said tariffs could result in higher project costs and endanger its existing and proposed U.S. plants, including several in Arizona.

TSMC broke ground on its third Arizona facility in April after committing $165 billion to expand its local operations.
